TITLE:------------------------------------------------------------------------ Privacy Officer------------------------------------REPORTS TO POSITION:-------------- VP, General CounselDEPARTMENT:-------------------------------------------- ComplianceOUR VISION:-- ------------------------ Creating America's healthiest community, togetherOUR MISSION:-- ------------------ In the spirit of love and compassion, better health, better care, better valueOUR VALUES:------------------------ Accountability, Caring and TeamworkDEPARTMENTAL SUMMARY: The St. Charles Health System's Compliance Department supports the ethics and integrity of the organization through the corporate compliance program, which is focused on the prevention, detection and correction of violations of federal, state and local laws and regulations, the Medicare Conditions of Participation, Joint Commission standards, organizational policies and procedures, and other applicable rules and standards.POSITION OVERVIEW: The Privacy Officer at St. Charles Health System (SCHS) works with the head of the Compliance Department to oversee, manage, and direct the health system's information privacy program.-- The Privacy Officer is responsible for helping to develop, enforce, and provide education on the health system's policies and procedures pertaining to HIPAA, HITECH, and the use and disclosure of protected health information. This position contributes to the fulfillment of St. Charles' mission, vision and values by serving as a key resource to the organization in the area of information privacy.-- This position is part of the St. Charles Health System Corporate Compliance department, and has additional duties including overseeing privacy and confidentiality requirements for work being done by the St. Charles Health System Research department and Institutional Review Board.-- This position also may provide direction regarding corporate compliance.--This Position may manage up to two caregivers.ESSENTIAL FUNCTIONS AND DUTIES: Maintains a strong working knowledge of federal, state and local laws and regulations pertaining to the access, use, and disclosure of protected health information, including, without limitation, HIPAA, HITECH, and Oregon's medical records privacy rules (collectively, the "Information Privacy Rules").Helps Compliance Department leadership to oversee, manage, and direct privacy functions within the Corporate Compliance Program, including activities related to the confidentiality, access, use and disclosure of protected health information and other confidential information.Assists in the planning, implementation, oversight, auditing, monitoring and ongoing operation of an effective information privacy program that meets applicable legal and regulatory requirements.Identifies, creates, and maintains system-wide privacy policies and procedures.Helps to create, update, and make available for use the Notice of Privacy Practices, the HIPAA authorization form, and other forms required by the Information Privacy Rules.Attends and helps lead meetings and discussions with internal and external partners on topics related to the Information Privacy Rules, the use and sharing of protected health information, and related matters.Develops and presents education and educational materials on information privacy, the privacy program, the Information Privacy Rules, and related topics to St. Charles organizational and administrative leaders, caregivers, and partners.Assists in the performance of initial and periodic information privacy risk assessments, including supporting the development and implementation of plans to address gaps identified during such assessments.Works with Information Security, Internal Audit, and other departments to complete periodic HIPAA security risk assessments.Helps administer a process for receiving, documenting, tracking, investigating and reporting on all complaints and allegations of privacy breaches and similar violations of the Information Privacy Rules.Ensures timely reporting of privacy breaches and related matters to patients and government entities, as required by the Information Privacy Rules.Helps develop and implement risk assessment tools to gauge in a consistent manner the severity of privacy breaches and related violations, as required by the Information Privacy Rules.Creates and executes an up-to-date, system-wide plan for providing initial and ongoing privacy education, training and orientation to all caregivers, volunteers, medical and professional staff, contractors, and other appropriate third parties.Works with the Human Resource department to develop and enforce appropriate disciplinary standards and/or sanctions for caregivers or others who fail to comply with the Information Privacy Rules and the health system's privacy policies and procedures.Works cooperatively with the Health Information Management department leadership and other applicable organizational units to ensure that patients can meaningfully exercise their rights to inspect, amend, restrict access to, and receive accountings of disclosures of, their protected health information, when appropriate.Collaborates with the health system's Information Security Officer, as needed, to ensure coordination between the information privacy program and the information security program.Exhibits professionalism and strong interpersonal skills while working with St. Charles' staff, managers, directors, executive team members and other caregivers. Delivers customer service and/or patient care in a manner that engenders trust and confidence, promotes goodwill, and is timely, efficient and accurate.Supports the vision, mission and values of the organization in all respects.Supports the Value Improvement Practice (VIP- Lean) principles of continuous improvement with energy and enthusiasm, functioning as a champion of change.Provides and maintains a safe environment for caregivers, patients and guests.Conducts all activities with the highest standards of professionalism and confidentiality.-- Complies with all applicable laws, regulations, policies and procedures, supporting the organization's corporate integrity efforts by acting in an ethical and appropriate manner, reporting known or suspected violation of applicable rules, and cooperating fully with all organizational investigations and proceedings.Perform additional duties of similar complexity within the organization, as required or assigned.EDUCATIONRequired:-- Bachelor's degree----Preferred:-- Master's degree or equivalent experienceLICENSURE/CERTIFICATION/REGISTRATIONRequired:-- Certified HIPAA Professional (CHP) or Certification in Healthcare Privacy Compliance (CHPC), or willingness to obtain the same within 6 months of hire. Valid Oregon driver's license and ability to meet St. Charles' driving requirements. Ability to travel to business functions/trainings/meetings and all St. Charles' worksites.Preferred: N/AEXPERIENCERequired:-- Minimum 5 years experience in the healthcare, compliance, or legal field, preferably in the capacity of a privacy officer, compliance professional, legal professional, or related position.-- Demonstrated experience with privacy regulations (such as HIPAA or FERPA). Strong organizational, leadership, written/verbal communication, training, presentation and problem-solving skills are essential.
